Award-winning legal, tax and fiduciary firm, Acumum – Legal and Advisory, is celebrating ten years in business. Founded in 2012 by director Geraldine Noel, the Malta-based firm now acts as a leading advisor to international clients with a range of legal, corporate and fiduciary services, with offices across Europe.

Starting out as a one-woman business, Acumum Legal & Advisory provided a vehicle for founder, Geraldine Noel, to use her years of expertise to help a wide range of international clients. With a Masters in Law from the University of Oxford and completing her LLM at Fordham University School of Law, and is currently completing her fourth post graduate degree in energy law, Noel gained valuable expertise as a barrister in London, as well as legal counsel for various global companies – NY, Switzerland & Cayman Islands. Geraldine is a barrister of England & Wales, Republic of Ireland and is registered in Malta and is also a founding partner of Acumum Chambers – an English barristers chambers located in Malta focusing on cross-border litigation and arbitration.

Celebrated throughout the industry, Noel’s work at Acumum – Legal & Advisory has seen her named in the Citywealth Power Woman Top 200 List every year from 2013 to 2020 and has also won awards for Best Businesswoman in Legal Services and Best Contribution in Business Service at the Malta Best Businesswoman Awards in 2021.

With a series of hires over the years, the boutique firm is now a leading expert in corporate law as well as aviation and maritime, pharmaceutical, bio-tech and medical cannabis, energy and wealth and estate services. The firm is also an accredited agent for Maltese citizenship and an authorised mandatory agent for all Maltese residency programmes. Dr. John Navarro joined the company in 2017 as junior legal counsel, qualifying as a Maltese advocate and rising to associate advocate. John is currently in the process of qualifying as an English barrister. In 2018, Michael Satariano joined as director of compliance, with years of corporate services and compliance experience. Finally in 2021, Dr. Geraldine Spiteri took up a full-time role as a lawyer and director designate, with the aim to set up the maritime and aviation section of the company as well as supporting and developing its advisory services.

Nomad Residence Permit

Overview

The increased prevalence of remote working due to the Covid-19 pandemic means individuals are now, more than ever, able to work from anywhere in the world. The Nomad Residence Permit allows third country nationals who can prove they are working remotely from Malta, to legally reside in Malta. This applies when applicants are working for entities or customers to whom they are providing services for, who are not based in Malta.  

Nomad residence permits are valid for one year and can be renewed on an annual basis, provided that the relevant eligibility criteria continue to be met. Spouses and children may also apply for residence as dependants of the main applicant.

Who can apply?

Applicants must be from a non-EU country, and cannot be EU, EEA or Swiss. Nationals of Afghanistan, North Korea, Iran, the Democratic Republic of Congo, Somalia, South Sudan, Sudan, Syria, Yemen, Venezuela, the Russian Federation and Belarus are currently ineligible.  

The programme is not available to refugees or persons granted subsidiary protection in Malta or any other EU, EAA or Swiss nation. It also does not apply to persons with the right to freedom of movement in the EU.  

Eligibility

Applicants must have a monthly gross income of at least €2,700 to apply. This threshold is increased for applicants applying with additional dependents and family members – approximately 20% per dependent.  

Applicants must also meet one of the following criteria to apply: 

  • Is a remote worker who has a contract of work for an employer registered in a foreign country  
  • Is self-employed and conducts business activities for a company registered in a foreign country and of which the applicant is a partner or shareholder 
  • Conducts freelance or consulting services on behalf of, mostly, establishments in a foreign country and whom the applicant has contracts with 

Applicants should also: 

  • Have valid travel documentation 
  • Have a travel insurance policy which adequately covers all risks in Malta  
  • Be able to provide proof of accommodation, being either rental or purchase of property. This can be temporary accommodation, however proof of permanent accommodation will be required following successful application. 

Background checks will need to be completed and applicants must adhere to standard procedures relating to visas or other residency permits.  

Applicants are also expected to pay taxes in their home country, and as part of the application process they will need to be able prove they are currently paying appropriate taxes. 

Dependent Family Members

Subject to the approval of a residency permit, the main applicant’s family and dependents may also be entitled to reside in Malta. The main applicant may apply for residency for dependents during the initial application process, or as a separate application once residency has been granted. Dependents include a spouse, children under 18 or adult children who are financially supported by the main applicant. The successful issuance of a residence permit for additional family members does not automatically grant them the right to work in Malta.  

Application Fees

€300 per main applicant and additional family member payable to Residency Malta Agency. For third country nationals who require a visa to enter Malta, an additional €300 per applicant for premium processing of the visa payable to Identity Malta Agency. 

Applications should be processed within 30 days of submission.

Acumum – Legal & Advisory Hosts Annual General Meeting of the International Jurists in Malta

On 23rd September 2022, Acumum – Legal & Advisory hosted the 2022 Annual General Meeting of the legal network International Jurists. Held at the Intercontinental Hotel in St. George’s Bay, St. Julian’s in Malta.

The event was attended by various member law firms of the global legal network. With presentations from a number of industry experts, the 3 day-long event covered important subjects from cyber security to professional indemnity as well as challenges to the legal profession.

The aim of the AGM was for member law firms from across the world to meet, with attendees from the UK, Malta, Sweden, Germany, Spain and more gathering for the event. As well as taking care of general administration for the network, the event held presentations and discussions on crucial topics to help create a learning environment for members to talk openly, exchange ideas, experiences and best practices in today’s world of law and share updates with fellow members.

The presentations started with Dr Marthese Portelli, CEO of Malta Chamber of Commerce and Ms Maria Zammit Micallef of Malta Enterprise. Other presentations followed from Carlo Pianese of Tribonian Law Firm, Thu Nga Haškovcová of Haškovcová & Co, Federico Vasoli of dmTV Global.

The afternoon sessions included a member’s discussion, which allowed for crucial face-to-face exchanges of ideas, support and learnings from challenges in the legal profession and best practices to overcoming them. Topics covered in the sessions included referrals, designed to improve awareness on how members interact with one another. This was followed by discussions on professional indemnity, standard business models and cyber security, all designed to encourage open discussion where members could share and take learnings from their experience in an ever-changing environment.

The afternoon concluded with further discussions on AML regulations and compliance and cryptocurrency, legal changes in different jurisdictions and secondments schemes, where members shared experiences of how they have supported the next generation of young lawyers and encouraging participation in future schemes to nurture young talent.

The event offered the opportunity to invite attendees to experience Malta with a guided walking tour of Valetta including visits to St. John’s Co-Cathedral and a Small Boat Harbour Tour. Plus, various opportunities for attendees and their spouses and partners to continue discussions and experience Maltese cuisine in St. Julian’s.

The event was attended by members of Acumum – Legal & Advisory, as well as and director and barrister Geraldine Noel, who also presented to members at the event as to Acumum’s range of expertise in sectors such as Aviation, Corporate, Energy, Maritime & Yachts, Pharmaceuticals. The AGM provided valuable takeaways on important topics giving insight into the challenges and experiences of fellow members from across the international law community.
