Key Employee Initiative

The Key Employee Initiative (KEI) has been introduced in Malta, providing a new, efficient programme for third country nationals / non – EU nationals (TCN) seeking employment and residence in Malta.Key Employee Initiative

The Key Employee Initiative aims to facilitate and to provide a fast track application process to highly-specialised third-country nationals who seek employment in Malta; applications will be approved within five working days from the date of submission of the application.

Eligibility

An individual may apply for a work/residence permit under the scheme if the employment position concerns a managerial or a highly-technical post which requires specific qualifications or adequate experience.

This scheme is also open to innovators who are involved in start-up projects which are specifically approved by Malta Enterprise.

Individuals applying under the KEI must:

  • Have an annual gross salary of at least € 30,000; and
  • Provide certified copies of the relevant qualifications, warrants or the necessary work experience;
  • Provide a declaration by the employer stating that they have the necessary credentials to perform the duties which they have been assigned.

Validity

Once the application is validated and approved, the applicant will be issued with a residence permit which is valid for 1 year. The permit may then be renewed for a maximum period of 3 years, subject to the submission of the documentation requested by Identity Malta, namely:

  1. A definite or an indefinite contract of employment, and
  2. The original annual tax declaration form stamped by the Inland Revenue Department.

Government Fee

The Government of Malta’s fee for the submission of the application is €280.50, to be paid at the time of submission.

Time-frame

Permits are issued within five working days from the date of submission of the application. The applicant does not need to be physically present to submit the application, therefore the applicant would not need to travel to Malta to submit the application.

Documents Required

1.  Application for a residence permit on the basis of employment – the form must be  endorsed by the employer with an official stamp and signature of the responsible official;
2. Identity Registration Form – Non-Maltese Nationals along with the application fee of
€280.50;
3. Full copy of passport;
4. Declaration by the employer stating that the applicant has the necessary credentials to perform the duties being assigned;
5. Draft work contract showing an annual gross salary of €30,000;
6. Curriculum Vitae of the applicant;
7. Certified copies of the relevant qualifications, warrants or reference letters;
8. Full health-insurance policy, showing all aspects being covered, which supports the applicant in the eventuality of requiring any type of medical assistance or hospitalisation during the first year of stay in Malta;
9. Lease agreement or purchase agreement of property.
10. Depending on type of job, a relevant health screening approval from the Health Promotion and Disease Prevention Directorate.

Malta EU Permanent Residency & Visa Rules For Non-EU Nationals

Malta EU Permanent Residency

The Malta Residence & Visa Programme Regulations have come into force via Legal Notice 288 of 2015 (Malta Residence & Visa Programme Regulations 2015), providing Malta EU permanent residency for non-EU nationals.

Applying to 3rd country nationals (non-EU/EEA/Swiss), the regulations set out new rules as to who may be entitled to a Residency Certificate conferring upon them and their dependants the right to reside, settle and stay indefinitely in Malta, provided that certain conditions are satisfied.

Upon approval the Residency Certificate will be reviewed annually for 5 years, then every 5 years thereafter, to ensure adherence to the regulations.

Qualification Conditions
To qualify for the Malta Residence Certificate, the main applicant must:

  • be a third country national and not a Maltese, EEA or Swiss national;
  • not be benefiting from any other Maltese tax or residency programme;
  • must be a fit and proper person.

Main applicant must attest via affidavit that he/she has:

  • €100,000 annual salary; or
  • €5000,0000 in assets

Financial Contribution – €30,000 contribution to the Maltese Government

Property – Rental: minimum annual rental payment has to be at least €12,000 if the immovable property is situated in Malta or €10,000 if in Gozo or in the south of Malta, OR, Purchase: minimum value must be €320,000 or if property is in the south of Malta or in Gozo, the minimum value can be €270,000

Investment – €250,000 in Malta for a minimum of 5 years.

Further Conditions
The main applicant must:

  • have a valid travel document for himself and his dependants;
  • have an ‘all-risks’ EU wide health insurance for himself and his dependants;
  • provide an affidavit stating that from the date of application he has EITHER an annual income of not less than €100,000 arising outside Malta, OR has capital of not less than €500,000.

Current beneficiaries of the Global Residence Programme are allowed to apply for the issuance of this Certificate, provided they satisfy all the additional eligibility requirements of these regulations.

Dependants 

The rules establish that dependants must be:

  1. a)the main applicant’s spouse in a monogamous marriage, or in another relationship having the same or a similar status to marriage;
  2. b)a child, including an adopted child, of the main applicant or of his spouse who is less than 18 years of age;
  3. c)a child of the main applicant, or of his spouse, between the age of 18 and 26 and is not married and not economically active;
  4. d)a parent or grandparent of the main applicant or the spouse, who is not economically active;
  5. e)a child of the main applicant or spouse, who is at least 18 years of age, and who has been certified by a recognised medical professional as having a disability in terms of the Equal Opportunities (Persons with Disability) Act and who is living with, and is fully supported by, the main applicant.

Submission of applications

A non-refundable administrative fee of €5,500 is to be paid upon application. Upon the applicant’s acceptance under the Malta Residence & Visa Programme Regulations and the issue of a Letter of Approval by Identity Malta, the €5,000 is deducted from the contribution of €30,000.

Applications, must be represented by a registered approved agent or an accredited person.

No Wealth Criteria

No Inheritance or Exit or Entry Taxes

The ‘Residence Programme Rules, 2014′, detailing new rules allowing for a special tax residency in Malta of EU/EEA/Swiss nationals have come into force pursuant to Legal Notice 270 of 2014 on the 8th of August 2014.

The legal notice and the programme have been given retrospective effect, thereby have been backdated from the 1st of July 2013.

Special Tax Status

Subject to satisfaction of the conditions of the programme, beneficiaries under the programme only pay

  • 15% tax on income brought into Malta (foreign sourced income), provided that a minimum amount of tax payable is €15,000 per year
  • Foreign sourced income not brought into Malta is not taxed in Malta
  • Capital gains are not taxed in Malta.

Under the Residence Programme Rules, the applicant must:

  • Property Rental
    • €9,600 per year in Malta, or
    • €8,750 per year in Gozo or in the south of Malta, OR
  • Property Purchase
    • €275,000 in Malta, or
    • €220,000 if situated in Gozo or in the south of Malta
  • Cannot benefit from other tax programmes of Malta – Residence Scheme Regulations, the High Net Worth Individuals Rules, the Malta Retirement Programme Rules, the Global Residence Programme Rules, the Qualifying Employment in Innovation and Creativity (Personal Tax) Rules or the Highly Qualified Persons Rules
  • Applicant has stable and regular resources that are sufficient to maintain the applicant and his dependants
  • Be in possession of a valid travel document
  • Have EU wide sickness insurance, covering himself and his dependants;
  • Speak adequately in English or Maltese
  • Fit and proper person
  • Not stay in any other jurisdiction for more than 183 days in a calendar year.

Individual Investor Programme (IIP)

The Government of Malta has recently reached an agreement with the EU Malta EU CitizenshipCommission on the Individual Investor Programme (IIP) which allows Malta to grant Maltese citizenship by investment to foreign individuals and their families.

The new citizenship programme – Malta Individual Investor Programme – is aimed at high net worth individuals and families wishing to secure citizenship of an EU member state with high standards of living.

The IIP grants Maltese residency to suitable applicants who qualify under the strict due diligence standards and vetting process, and who make a significant contribution to the economic development of Malta via the National Development Fund established by the Government.

Eligible persons will be required to meet the following minimum requirements:

  • Contribute at least €650,000 to the Maltese National Development and Social Fund;
  • Hold a property in Malta (of a value of minimum €350,000 if purchased or annual payments of minimum €16,000 if rented) for a period of at least five years;
  • Invest at least €150,000 in local stocks, bonds, debentures, special purpose vehicles or other investments accepted by Identity Malta for a period of at least five years.

Individuals must satisfy a residency requirement of a minimum period of 12 months and will be subject to extensive due diligence checks, including a personal interview before naturalisation is granted.
