Are you an Art.50 Brexit Maltese residency card holder? Did you update your residency card at the time of Brexit?

Do you know that ordinary Brexit card holders may lose their right to reside in Malta if you are absent from Malta for more than 6 months?

Benefits of a Malta Permanent Residency Card:

• You can be out of Malta for up to 5 years
• You can access Malta’s social services and in particular the services of Active Aging Ministry such as: care in home, handyman, meals on wheels, monetary grants.

Taxation

Permanent residents will change their Malta taxation to world-wide. However, this may not affect you if you are retired and have income that is of a foreign capital nature.

How to Apply for Permanent Residence in Malta (British Nationals)

If you are a British national who has lived in Malta for at least five years, you can apply for permeant residence status under the Art. 50 / Brexit Withdrawal Agreement (Artikolu 18(1) Tal-Ftehim).

Step 1: Prepare your documents

You must scan and save the following documents as PDF files:

• A copy of the front and back of your current Malta residence card
• A copy of the bio page of your valid passport
• Prepare a letter to the Expatriates Unit which includes the date of your first arrival in Malta and list all periods you were absent in Malta during the last five years (with approximate dates, for example ‘June 2023-August 2023’)
• Evidence of continuous residence in Malta for the last five years. Depending on your situation you can provide documents such as:
• If you are employed:
• Copies of engagement letters
• Employment contracts
• FS3 forms and payslips
• If you are Self-Employed:
• Official tax payment documents
• Engagement forms
• Copies of work contracts
• If you are Self-Sufficient:
• Copies of bank statements showing regular activity in Malta over the last 5 years
• Utility bills
• Rental agreements
• ONLY if you are unable to provide bank statements: a declaration from your doctor confirming you have been under their care in Malta for the last 5 years.

You do not need to provide every document listed above. You only need to provide enough evidence to show that you have been living in Malta continuously during the last 5 years.

Step 2: Send your application by email

Scan all your documents and save them as PDF files.

Send your application by email to the Brexit Unit at Identita Malta: brexit.identita@gov.mt

In your email, include:

• Your full name
• That you are applying for ‘Permanent Residence – New Application’
• Attach to your email all the required documents as PDFs.

Step 3: Wait for Identita to review your application

Identita will review your application and will contact you if they need any additional information or documents.
If your application is approved, you will receive an email with a link to book your biometrics appointment.

Step 4: Book your biometrics appointment

Use the link in the email from Identita to book your biometrics appointment.
You must attend the appointment in person with a copy of the application documents.

Step 5: Wait for your residence card

After you attend your biometrics appointment, your new residence card will be issued.
The card usually takes approximately 3–6 weeks to be issued.
You will receive a letter at your home address, which will inform you that your residence card is ready for collection.

Disabled / Elderly / Bed Bound

Identita has an outreach service, where Identita will come to you in limited circumstances.
In order to use this service, you must provide Identita with a letter from your doctor stating that you are bed- bound / unable to leave your home. Upload this document with your application at the time of submitting your documentation.
Mark your application email to Identita as ‘Permanent Residence – New Application – Outreach’.
